Sidney Hudig:

It is with a very heavy heart that I must write to tell you all that early in the morning on Wednesday of this week, Sidney Hudig a resident in the West building passed away. For those that knew her, she was a powerhouse. Sidney was a contributing member of the community partaking in the social committees and attending regular meetings of the association. She enjoyed ushering for the symphony, boogie boarding, attending her local church, and catching up with residents at every opportunity. She will be dearly missed by all of us.

Window Washing Schedule:

As a reminder- we begin window washing next week on Monday. Thank you to all who have reached out to me about rescheduling window washing. I am going to put the schedule below here again for everyone.

Town Hall Recap:

This past week the association held a town hall to discuss the proposed CC&R amendments. Assembly Bill 3182 was passed in the statehouse to change the restrictions that associations can put on rental units. The intent behind the bill is to free up more rental space to address the housing crisis in California. This new bill takes effect on January 1st, 2022. Between now and then, associations must change their governing documents to meet the new standard. To meet the new California Civil Code section 4741 added to Davis-Stirling Common Interest Development Act, Coral Tree Plaza must adopt three specific changes concerning rental units.

1-     The rental cap on units must be no less than 25% of the units (which comes out to 32 units when rounded up).

2-     The association must eliminate the 12 months “waiting period” that prohibits new owners from renting out their units as soon as they close on their new home.

3-     The association must eliminate the requirement that all lease agreements be 12 months or greater. Now the association can permit rentals as short as 30 days (but no less than 30 days).

The important part to note in all of this is: the association is required to make these changes to meet the standard set by the new law. In other words, Coral Tree Plaza must approve these new changes to the rental restrictions or it risks possible fines from the government for being out of compliance with California Civil Code.

Additionally, the Board discussed eliminating the antiquated language in the CC&R’s about pet restrictions and moving the restrictions over to the Rules and Regulations. This allows the Board to make changes to the Rules and Regulations specific to pets without going out to the full association to vote on the changes. Having pet restrictions listed out in the Rules and Regulations is a common practice in condominium associations that are built nowadays.

The final topic of discussion at the town hall was about adding a specific clause to the CC&R’s that grants the Board of Directors to make changes to the governing document whenever they are required by the Civil Code. An example of this new clause in action would be if the Board had to change the rental rules and restrictions of the association again to meet a new civil code requirement, they would be able to do so without having to call for a full community vote. The association has to pay thousands of dollars to amend the governing documents when everyone has to vote to make required changes. This new adage to the CC&R’s would grant the Board permission to make changes that are required by the law. Please note that this power granted to the Board would be exclusively for changes that new laws require, and the scope would not be beyond that. Meaning the Board cannot make any changes to the governing documents besides that which is specifically laid out in a new law.

Contractor Hours:

This week, the Board met on Tuesday to discuss the status of the emergency rules restricting the contractor hours at the association. The Board voted and agreed to pass an additional emergency rule at the association eliminating Saturday work. This takes effect immediately. So as of Tuesday, June 8th the work hours for unit renovations are as follows:

Monday: 9:00 am – 5:00 pm

Tuesday: 9:00 am – 5:00 pm

Wednesday: 9:00 am – 5:00 pm

Thursday: 9:00 am – 5:00 pm

Friday: 9:00 am – 5:00 pm

Saturday: No Work

Sunday: No Work

The new hours are posted in the lobbies of both buildings. If contractors are working inside of the buildings this weekend, please send me an email notifying me of the time that you noticed them working onsite and what building you noticed them working in.

Trash Chute Cleaning:

I think we have all had enough of the trash chutes being clogged and more importantly, being stinky. Well look no further, your wonderful Board has approved a deep cleaning of the trash chutes through ProTec Janitorial services. ProTec is going to come out onsite and not only powerwash the trash chutes, but they are also going to scrape them down. They will be scraping off any debris that has built up over the years. They will also be deep cleaning the trash rooms. The hope in doing this is that the chutes will not smell so strongly and that during the hot months the trash chute won’t be such a miserable place to dump refuse. That is not to say that you should start dumping large items down the chute just because it has been well cleaned. Please still refrain from throwing large items down the trash chute and getting it clogged. That is still not ok to do no matter the condition of the trash chute.

Dumpster Status:

Waste Management is scheduled to come and pick up the large dumpster today at the close of business. They were late to drop off the dumpster on Monday so they may give us an extra day with the dumpster but this has not yet been confirmed with Waste Management. Please remember that you cannot dump items such as paint or electronics. I am scheduling another e-waste pickup for the association. And if you have any old paint that you would like to get rid of- you can bring it to Dunn-Edwards and they will take it off your hands and recycle it for you.
